Plight of Susta villagers


Susta ko bedana
Nawalparasi jillako susta ko betha ahile badhera gayeko chha. Ekatir narayani nadi ko badhiko prakop chha ta arko tira bharatiya haruko prakop. Barseni badhile jamin katan gari Nepali haru lai bisthapit gardai chha. Pul ko abhaw ma nepali le afno jamin ko dekhbhal garna na sakda bharatiya haru le susta ko 14000 hectare jamin ma kabja jamayeka chhan. Susta chichyaeko chichyayekai chha…..dherai barsa bhayo. Rajya moun chha. Susta jhain nepalko dherai sthan haruma bhartiya haruko atikraman badhera gayeko chha. Afno desko sima ra astitwo ko rakchhya garna baseko police ko office ra barrack ko awastha herda jhan birakta lagchha. rastriyeta ko mamla ma hami kati sanbedanshil chhaun bhanne kura yinle spasta parchhan.
Hami nepali haru apasma jat, jati, dharma, sanskriti, chhetra, adi jhina masina kura ma aljhiraheka chhaun. Uta Nepal lai nildai chha ajingarle.
Lau na kehi garaun…hami sabai milera….rastara ra rastriyaeta jogaun.

कार्य पत्र प्रस्तोता लाइ धेरै मिहिनेत गरी तयार गरेको कार्यपत्रका लागी धन्यवाद । उहाँ बाट आगामी दिन हरुमा केही गृह कार्य गर्नु पर्ने अनुभव  गरेको छु ।

सिमावर्ति अपराध हरु मध्य हाल देखा परेको माओवादि बिद्रोह को ब्यापकता देश भित्र र बाहिर कति छ ? र बाहिर बाट कति प्रायोजित छ भन्ने कुराको लेखा जोखा गर्न जरुरी छ । माओवादि बिद्रोह को बारेमा हामी सबैको कन्सेप्चुयल क्लारिटि हुनु, अप्शन हरुको लेखाजोखा हुनु, स्टाटेजिको छनौट गर्नु, नितिको निर्माण गर्नु, र तयारी गर्नु जस्ता महत्वपर्ण पक्षहरुमा हाम्रो ध्यान केन्द्रित हुन जरुरी छ ।

नेपाल भारत सिमाना बाट आउने ब्यक्ति हरुको निग्रानि र नियण्त्रण प्रणाली, एन्क्रोचमेन्टको लेखाजोखा तथा सीमा स्तम्भ हरुको बारेमा अपटुडेट रिकर्ड राखिनु आवश्यक छ । यसकालागी प्रहरी, भन्सार गस्ति प्रहरी र कतिपय स्थानहरुमा बन रक्षक गस्ति टोली लाइ राम्रो ओरियन्टेशन दिने (उनि हरुलाइ म्यानडेट दिने) र स्थानिय नागरिक हरुलाइ समेत यस तर्फ सचेत र संवेदनशील बनाउनु पर्ने देखिन्छ । यस क्षेत्रमा अहिले पार्टिसिपेटिभ एडमिनिस्टेशनको कमि देखिएको छ ।

एउटै भेष भुषा, भाषा, संस्कृतिकै कारण दुइवटा सार्वभौमसत्ता सम्पन्न राज्यका बिचमा अन्तर्राष्टिय सिमा खुला राखिनु पर्छ भन्ने कुरा गलत हो । सौहार्दपुर्ण सम्बन्ध राख्नु हाम्रो वैदेशिक निति हो तर यसको अर्थ खुला सिमाना राख्नु पर्छ भन्ने होइन । सौहार्दपुर्ण सम्बन्ध सिमाको प्रभावकारी ब्यवस्थापन बाट मात्र हुन सक्दछ भन्ने कुरा हामीले बिर्सन मिलदैन । त्यसर्थ दुइ देश बिच रहेको सीमा लाइ ब्यवस्थित गर्नु पर्ने देखिन्छ । सीमा ब्यवस्थापनको सवाल राष्टिय सुरक्षाको सवाल हो । यस्मा मतभेद हुनु हुदैन । यो पार्टीगत र ब्यक्तिगत स्वार्थ भन्दा माथि हुनु पर्छ । गोप्य सन्धि संझौता हुनु हुदैन ।

नेपाल भारत सिमामा हुने चोरी पैठारी रोक्नका लागी the custom mechanism should be based on sound economic policies rather than on army and police. भन्सार गस्ति प्रहरी तथा राजस्व प्रशासनिक संयन्त्र हरुलाइ प्रभावकारी बनाउन जरुरी छ । Other wise we will be only shifting responsibilities of failure from one agency to another. The attitude of fast-fix strategy would not work. We need to have a long term vision. Change without any investment and commitment is not possible. No one can bring a good result overnight.

Security threats to the banks and financial institutions have sharply increased over the last few years (Information leakage, security lapses to blame for bank heists, 13 Dec). But investing for enhancing security is often overlooked and even considered "necessary evil" in our country. This is troubling.
Security is an evolving process and it must be carefully planned from the very beginning. Security functions are integral to business systems. Thus, each responsible organization needs to have formally written policies and guidelines that include administrative, technical, and physical securities. Planning for security in advance of deployment will provide a more complete and cost effective solution. Advance security planning will ensure that security services are supportable and available when necessary.
A functioning security system is vital for banks and financial institutions. Banks have to transfer a large amount of cash to service centres in the morning and collect the deposits in the evening. They may sometimes have to compromise with security principles in practice, rendering the cash-in-transit even more vulnerable to looting and robbery. The repetitive modus operandi that staffs and guards follow creates fertile grounds for criminals. Criminals can often easily take the situation under their control.
There is no reliable security system in place even for transportation of cash from various customs offices of the country. Often vehicles ferrying cash are escorted by two unarmed guards—sometimes only one armed guard. Such vehicles are small but they have to accommodate large boxes, staffs, and guards. This increases the security risk even more. In case of highway robbery, the guards wont be able to open fire from their weapons because they are squeezed inside the tiny vehicle. Thus, even having guards may not be enough to contain the situation sometimes.
It's extremely necessary to improve the security system at banks and financial institutions. I suggest the following measures: First, banks need to inform the police and get police escort before they ferry cash from one place to another. Second, they need to increase the number of trained armed guards for escorting, and finally, they need to design a safe vault inside the vehicle itself to carry cash. If not, they need to procure armored vehicles for the purpose.

Meet raises concern over human traffickingSTAFF REPORTER
 GUWAHATI, Dec 6 – The need to overhaul the prosecution system and strengthen the anti-human trafficking units (AHTU) to tackle with the growing menace of illegal trade of human beings for the purpose of sexual exploitation, bonded labour, slavery, etc., was highlighted by the stakeholders at the third edition of the Trafficking in Persons (TIP) Conclave held here on Friday.

The event hosted by the US Consulate, Kolkata in association with the Impulse NGO Network saw participants voicing concern over the unsatisfactory political commitment to deal with the crime.
Advocate and anti-human trafficking expert Bhuwan Ribhu, while regretting the lack of government support towards rehabilitation of the victims, said the victims from the marginalized section of the society hardly get any assistance from the government. He called for changes in the legal system to ensure the protection of the victims and witnesses, and fast track trial of the cases.
Addressing the meet, Mukesh Sahay, ADGP, CID said that apart from strengthening the AHTU, it is also important to synergize partnership with all the stakeholders. Mentioning that the law enforcing agency alone cannot deal with the issue, Sahay said that all stakeholders must come together to prevent and suppress human trafficking, while helping the authorities to punish the culprits.
Sahay said though the Assam Police has 14 anti-human trafficking units to deal with the menace, shortage of manpower has affected their efficient functioning.
It needs to be mentioned here that of late, Assam has witnessed a spate in human trafficking with women and children from natural calamities and conflict affected districts being lured with the promise of job to places such as Delhi, Mumbai, Haryana, Rajasthan and Gujarat. The districts that have become vulnerable to human trafficking include Lakhimpur, Dhemaji, Baksa, Nagaon and areas on the Bangladesh border.
It was pointed out by Mirandi Ingtipi, ASP, CID, Assam that most of the victims of Assam had been lured by the fake placement agencies.
The meet was attended by representatives of civil society organizations, government officials and media from the five participating countries – India, Bangladesh, Nepal, Bhutan and Myanmar. GP Thapa, Additional Inspector General of Police (retd), Nepal called for a professional approach to tackle human trafficking.
Chief Minister Tarun Gogoi, who was also present at the meet, called for sustained and continued efforts to create awareness on the issue and prevent the same. He expressed concern over the increasing crimes against women and children, and said that his government was taking steps to stop such crimes. He also stressed the need for dealing with the issue through economic empowerment of the marginalized section.

Nepal bandha to disrupt CA election

Community Party of Nepal (Maoist) and its alliance have started a ten days general strike in protest of CA election. What an irony. The security of voters in the election has raised question. There have been several sporadic violence through out the country.
Last week, the UN resident coordinator in Nepal on behalf of international community, urged the agitating parties not to impose general strike in the run up to the election. The statement was issued following a meeting of envoys from India, China, the United States of America, the United Kingdom, Russia and France among other 23 countries.

What do China blasts indicate?

One person was killed and eight others injured as series of seven blasts rocked the provincial office of the Communist Party in the northern Chines city of Taiyuan on Wednesday, Nov 6.  It is not the first time that things uncommon took place in China--these are some of them: July 2008--a man sets off explosions on two buses at Kunming (Yunnan province) killing two; June 2009--an unemployed man in Chengdu (Sichuan province) sets a bus on fire killing 28 people including himself; July 2010--an unsuccessful businessman sets an airport shuttle bus on fire in Changsa (Hunan province) killing two people; May 2011--a man sets off explosions outside government offices in Fuzhohou (Jiangxi province) killing three including himself; June 2013--a man kills 47 people including himself on a bus in Xiamen (Fujian province) to 'vent personal grievances'; July 2013--a disabled man sets off an explosion at Beijing's international airport to protest police assault; Cot 2013--a car ploughs into the crowd on Tiananmen Square in Beijing and bursts into flames killing five persons including two tourists.
What do all these incidents indicate? Recent attacks in China have provoked discussion about social and economic inequality (the BBC's Lucy Williamson reports).

Gender-based violence in Nepal

Gender violence is the most generalized forms of exclusion in Nepali society. Violence against women includes physical, sexual, and psychological violence that occurs within the family and the community. Nepal has traditional society and culture which dishonors woman’s voice and encourages family pride. The Nepali
societal culture is an introvert one, which shows aversion to change and displays a keen instinct for retention and preservation of ideas and traditions.

Nepal election security

There were no fatal incidences this week but reports of mild to serious injuries have grown in number. Torching and vandalizing campaign vehicles have become the most prevalent anti-poll activity this week. The bandhs called by parties opposing the election have become more frequent and most of the calls have tended to affect normal life and vehicular traffic. In general, while incidences of violence have increased the security situation has not gone out of control. The nature of violence remains spontaneous and sporadic rather than systemic and widespread.
The police strategy  to cope with these kinds of incidents are like 'fire brigade' type. The police find difficulty is preventing the crimes. The sole reason for this is lack of proper and efficient intelligence system. Police need to develop efficient intelligence sytem to ward off incidents in a proactive way.

Human trafficking in Karnataka

Karnataka is listed as third state to have the problems of human trafficking. In a report of home ministry of India, Karnataka is third with 336, 263, 368, 412 number of human trafficking cases during 2009, 2010, 2011, and 2012 respectively. Tamilnadu and Andhra Pradesh are first and second respectively in the list. Bangalore is becoming another Mumbai.

7 killed, 40 injured in Karnataka bus fire

The tragedy comes two weeks after 45 people had died when a Volvo bus from Bangalore to Hyderabad had caught fire after hitting the median on the national highway in Mahabubnagar district of Andhra Pradesh.

BANGALORE: A week after 45 passengers were charred to death in a bus near Mehbubnagar in Andhra Pradesh, 35 passengers in a bus from Hassan to Bangalore had a miraculous escape on Thursday evening. The KSRTC Vaibhav, manufactured by Tata, was gutted in an accidental fire near Goraguntepalya Signal on Tumkur Road, 14 km from the city.

Fifty-two persons, including 50 passengers, were travelling in the Volvo bus when the mishap occurred. Initial reports had said that some software engineers were among the victims. Forty-five passengers were charred to death as a private bust burst into flames after its fuel tank caught fire in Mahbubnagar district of Andhra Pradesh early on Wednesday, October 30, 2013. This incident poses a serious question of safety and security measures adopted by the concerned agencies and individuals.
"Most private operators compromise on passengers' safety. They don't create enough space for emergency exits and use it to add more seats. Neither do they use speed governors. For example, they cover 350km between Chennai and Bangalore in under four hours. This is a perfect recipe for disaster in case of accidents," Bhaskar Rao, transport commissioner from July 2008 to May 2011 and currently IGP (Northern Range), Belgaum, told TOI.

Be careful of loud crackers in Diwali

Fire crackers during Diwali is common and has become a way of culture in India. The research conducted by Maharashtra Pollution Control Board and Awaaz Foundation found that crackers breached sound limits, with serial crackers being the worst. Loud crackers 'cause annoyance and aggression, hypertension, high stress levels, tinnitus, hearing loss, sleep disturbance, heart disease, and mental illness'. Most of the fire crackers sold in India accede the dB level. 'A cracker that makes noise exceeding 125 dB at 5 meters from the spot of bursting should be banned' says Noise Pollution Control Board and endorsed by the Union Environment Ministry of India. Nepal government has put restrictions on the use of fire crackers during Diwali not because of these health hazards but other serious physical casualties and possible misuse by terrorists.

Is policing a thankless job?


The evidences are important in the course of proving the guilt of suspects in any crimes. Quite often police have to make arrests upon suspicion. They have reasons and legal rights to do so. However, their acts must also be proved right. Police have to face the public sarcasm if they do not produce evidences against the arrestees. This is exactly what happened with the Bangalore police. They had arrested 17 people in suspicion in connection of bomb blasts those went off on April 17 at Malleswaram. After six months of rigorous investigation, suspects, except three, have been charge-sheeted for their crimes. There is public outrage for the lapses on part of police to have ‘arrested and kept them in jail for so long’ without any evidences. The police have done a good job but public do not appreciate; they only look out for police lapses. That is why police job is often a thankless job.

I wonder what is happening to the police these days. More than one hundred people, 115 as reported so far, died in a stampede which occurred in Ratangarh on October 13, 2013. one witness said, "I hear pilgrims screaming on the bridge tht police were dumping bodies and throwing injured and alive children into the river. I rescued six children from the site f the stampede, including one from the river." Another witness, Indel Aharwar, says, "I have seen policemen  dumping children into the river. it was a heart-wrenching scene...I am ready to testify before any court".(The Times of India, Bangalore, October 15, 2013 Bhopal: Madhya Pradesh Government on Wednesday announced constitution of a commission to be headed by Justice (retd) Rakesh Saksena of the high court to probe the Ratangarh temple stampede in which 115 people were killed and many injured. The decision to appoint Justice (retd) Saksena of the Madhya Pradesh high court was taken by chief minister Shivraj Singh Chouhan, official sources said. The one-member panel, to be headquartered at Gwalior, is mandated to probe the circumstances that led to the stampede on Sunday and the role of district and police officials concerned. The commission will have to submit its report, along with recommendations, within two months. A total of 115 people were killed and scores of others injured following a stampede on a bridge over Sindh river leading to a temple in Datia district on October 13. Meanwhile, taking a suo motu cognisance of the case, the Madhya Pradesh Human Rights Commission (MPHRC) has issued a notice to the state chief secretary and the DGP directing them to file their reply on the tragedy within a week. MP Govt constitutes judicial panel to probe Ratangarh stampede MPHRC chairman, Justice A K Saxena issued the notice directing them to reply on various issues including lapses and action taken by the government against those responsible for the stampede. The state government has already suspended a total of 21 officials and policemen including Datia district Collector and Superintendent of Police in the wake of the incident.

A serial killer and rapist Jaishankar alias M. Shankar, 34, who escaped from the Central Jail on August 31 and was caught six days later, said that he could flee from the jail with the help from prison officials and other inmates. (The Times of India, Bangalore, October 22, 2013, p. 5)

And now again, there is news that, "City police appear to be the wrong side of the law again. A week after a sub-inspector and two constables were allegedly caught looting cash and gold jewelry from a maid servant who was accused of theft, an inspector is accused of robbing a known offender." The report said, "The inspector collected 600 gm of gold jewelry from Pasha. Though he did record other recoveries from Pasha, he did not register 50 gm of jewelry pertaining to a case reported at Parappana Agrahara police station."(The Times of India, Bangalore, Wednesday, October 23, 2013, p. 5)
These are examples of police character in South Asia or/and throughout the world. When such things are not controlled, who will police the police?

Missing children

Combating human trafficking in Nepal

The initial year of my work as the Senior Technical Adviser to the National Committee for Controlling Human Trafficking (NCCHT), under Ministry of Women, Children and Social Welfare (MoWCSW), involved understanding the nature of problems, reviewing organizational structure and capacity, some planning and proposing. The second half of the period was more on key policy and system building, program outlining and resources planning for the implementation of National Plan of Action (NPA).  The process of institutionalization of NCCHT is afoot; albeit slow in pace. The Asia Foundation's Combating Traffic in Person (CTIP) program has agreed to support the annual program of NCCHT. This will consolidate the efforts to establish and develop the capacity of the institution in days to come.
My learning in relation to countering human trafficking during these two years was very much exciting, illuminating and challenging. Following are some of the key issues related to this problem in our context:
1. The pattern of human trafficking is ever changing in terms of its cause, purpose, selection of victims, destination, proportions and trends of criminal activities, dimension of crime and modus operandi. These paradigms have increased challenges to combating front.
2. Gender based attitude and mindset are the source of other violence against women—including trafficking. Therefore controlling human trafficking requires a holistic approach to gender based violence; focus on human trafficking in isolation would not be effective. Strong leadership, expanded partnership, concerted and deeply entrenched programs would produce substantive results.
3. Implementation of policies related to control these crimes often does not get priority in the government system. The rules of responsibility and accountability are not strictly followed. I feel NCCHT is under resourced and under utilized for various reasons including these.
4. Lack of coherent cooperation and coordination between state machinery is a major problem. It might warrant several structural renovations and capacity building of agencies in the current setting.
5. Human trafficking is one of several organized crimes. The control of organized crimes is all time a challenge in the country. There are some domestic legislative obstacles to overcome the complexity of organized crimes.
6. The detection, investigation and prosecution of organized crimes are difficult. It warrants more effective and efficient operational system improvement at domestic and cooperation at international level. The capacity of police is also needed to be enhanced.
7. Protection and reintegration of survivors in the society is still not orchestrated. The survivors/victims still suffer from social indictment. An attitudinal shift of society can only bring substantial change in this sector.
8. Social mobilization towards safer societies is essential to control all forms of gender based violence. There is need for paradigm shift in the attitudes and behavior of the society towards survivors/victims.
9. Community empowerment is basic need for effective implementation of policies. There is need for mobilizing existing community networks at grass root level for these purposes.
10. It has a political solution. The political commitment and leadership to it is important.
