Application of law in practice


All crimes enlisted in the Schedule 1 of State Cases Act 2049 BS are investigated and prosecuted by the State. The State is the party for such cases. The legal provision for reporting of a crime which is already committed and which is being committed or about to occur, is made in the State Cases Act 2049, Clause 3. The law expects reporting of crimes from any person having knowledge of the crime taken place or is about to take place. He/she shall give information in writing or orally to the nearest police station as soon as possible. Such information must state all those evidences produced by him/her or those known or seen by him/her. The means of reporting are generally oral, telephone call, mail, and personal contact to police stations and/or police report itself depending upon the situation.
